Chennai: Madras High Court today posted before another bench the case relating to removal of a statue of veteran Tamil actor Sivaji Ganesan from a busy road here.

The First Bench, comprising Chief Justice R K Agrawal and Justice M Sathyanarayanan, while admitting an impleading petition filed by K Chandrasekharan, President of the Sivaji Ganesan Samooganala Peravai, a society registered under the TN Societies Registration Act, posted it before the second bench for further hearing on December 17.

A petition had been earlier filed by one P N Srinivasan seeking a direction to remove the statue before the DGP office at Kamarajar Salai on the ground that it hindered free flow of traffic.

After his death, P Nagarajan pursued the case.

In his report, the Assistant Commissioner of Police, Traffic, Mylapore, had said the statue affected the visibility of motorists during night hours and that several accidents had taken place and suggested its removal.

The impleading petitioner claimed that when the writ plea for removal of the statue came up in 2006, the then Advocate General had submitted that it would not in any way be an hindrance to the free flow of traffic.

The petitioner also submitted that the national emblem and clock tower, erected several years ago, was situated at a height more than that of the statue and it had not created any hindrance to traffic and prayed to be impleaded.
