The Supreme Court on Monday reopened after 6 days and it is expected to deliver verdicts on some of the key issues that have been pending since long. The important issues include the Rafale deal case, the Sabarimala temple case and the verdict on bringing the office of the Chief Justice of India (CJI) under the right to information act. Besides, the court will also take up some crucial matters for hearing, including the one related to sexual harassment allegations against the CJI.
Law Minister Ravi Shankar Prasad in a written reply said 43.55 lakh cases are pending in the high court and out of these, 18.75 lakh relate to civil matters and 12.15 lakh are criminal cases.
A three-judge in-house committee, comprising Madras High Court Chief Justice Indira Banerjee, Sikkim High Court Chief Justice S K Agnihotri and Madhya Pradesh High Court's Justice P K Jaiswal, had in January 2018 concluded there was sufficient substance in the allegations contained in the complaint against Justice Shukla and that the aberrations were serious enough to call for initiation of proceedings for his removal.
Chief Justice of India Ranjan Gogoi has written to Prime Minister Narendra Modi seeking to increase the strength of judges and raise the retirement age of high court judges to 65 years.
Immediately after the office of apex court's Secretary General came out with the findings of the committee, the woman issued a press statement saying that she was "highly disappointed and dejected".
The statement, which has been issued from the office of the Supreme Court's secretary general, said that it is most unfortunate that a leading newspaper chose to state that the two judges met Justice Bobde.
Advocate Utsav Bains, who claimed he was offered money to frame Chief Justice of India Ranjan Gogoi in a sexual harassment case, has said the “mastermind behind the conspiracy is one of the biggest corporates in the country”
When contacted, Justice Bobde, who is next to the CJI in seniority, confirmed the development.
"Its wisdom continues to guide us in moments of crisis. It's in our best interest to heed advice under the constitution. If we don't, our hubris will result in sharp descent into chaos,” news agency ANI quoted him as saying during an event on Constitution Day.
Justice Gogoi has succeeded outgoing CJI Justice Dipak Misra who demitted office on October 2
On September 3, the president has appointed Justice Gogoi as the 46th Chief Justice of India. He will take oath on October 3 after incumbent Chief Justice Dipak Misra retires.
Justice Gogoi’s tenure will last till November 2019.
Justice Gogoi is one of the four Supreme Court judges who had held an unprecedented press conference in January this year, raising concerns about the administration in the apex court, saying it was "not in order".
"There may be some elements who try to weaken the institution, but the judiciary will refuse to succumb," the CJI said.
The Supreme Court on Thursday said matrimonial sanctity is an issue but the penal provision on adultery is apparently violative of the right to equality under the Constitution as it treats married men and married women differently.
People must check for rumours on social media: CJI on mob lynching
Roster system: There is no dispute that the CJI is the master of the roster and first among equals, says Supreme Court
Shanti Bhushan, in his petition, had suggested that rostering of judges and assigning of cases should be decided by a panel of senior judges rather that the CJI.
He has decided correctly. He need not have taken two days to make the decision. Congress committed suicide by doing this: Subramanian Swamy on rejection of Impeachment Motion notice againt CJI Dipak Misra
