Supreme Court big verdict on same-sex marriage; refuses to recognise in 3: 2 split verdict
Supreme Court held that the law does not recognise the right to marry or have civil union for same sex couples. It is upto Parliament to make law for it. The verdict was pronounced with 3:2 judgements (Justices S Ravindra Bhat, PS Narasimha and Hima Kohli: CJI DY Chandrachud and Justice SK Kaul).
Same-sex marriage: CJI DY Chandrachud, while pronouncing the verdict, said it is incorrect to state that marriage is a static and unchanging institution and the reforms in marriage have been brought about by Acts of the legislature.
Then Delhi Deputy Chief Minister Manish Sisodia was arrested by the CBI on February 26 in the alleged excise policy scam. The Delhi government implemented the policy on November 17, 2021 but scrapped it at the end of September 2022 amid allegations of corruption.
Earlier on May 11, a five-judge constitution bench headed by Chief Justice DY Chandrachud reserved its verdict on the pleas after a marathon hearing of 10 days. The matter will be taken up again on Tuesday, October 17.
While hearing the matter, the apex court observed that the termination of a 26-week pregnancy can not be allowed as it would violate the provisions under the Medical Termination of Pregnancy (MTP) Act.
The Supreme Court was hearing the bail application filed by AAP leader Manish Sisodia in the liquor policy case.
