Education Row: Smriti Irani may face 6 months imprisonment

New Delhi: HRD minister Smriti Irani's three contradictory sworn affidavits filed before the Election Commission in 2004, 2011 and 2014 elections could cause discomfiture and political embarrassment.The issue at stake is not her educational qualification

Her nomination papers for 2011 Rajya Sabha polls was accompanied by the obligatory affidavit wherein she mentioned her educational qualifications as B.Com Part I, School of Correspondence Course, Delhi University, 1994.

In the affidavit filed by her for the Lok Sabha elections in 2004 she mentioned her educational qualifications as BA from School of Correspondence, Delhi University, in 1996. But in the 2014 Amethi elections, she again declared her educational qualifications as B.Com part I.
 
Legal experts say that she can be jailed for six months for filing false affidavit and there is no time bar for it.

It is a different matter, even if she is jailed for six months, she can continue as MP and cannot be disqualified.

Since the law states that as long as the imprisonment is less than two years, it does not invite disqualification of the membership of Parliament, she can continue as a member of Parliament and therefore as a minister, even while undergoing imprisonment, opined legal experts.
