Chennai, July 16: The Madras High Court yesterday made it clear that physically challenged persons should get the minimum qualifying marks prescribed by government and only then will they be eligible for appointment to the post of secondary grade teacher.




Dismissing a  writ petition filed by one K.Kumaravelu, who appeared in Tamil Nadu Teacher Eligibility Test conducted last year, Justice D.Hariparanthaman said only if they get the qualifying marks in Teacher Eligibility Test are they eligible for the three per cent reservation for physically challenged persons for appointment to the post.

The petitioner, who secured 83 marks in TET, sought the relaxation from pass marks of 90 and made a representation to the government to fix the pass marks in the lower level for physically handicapped. The Additional Government Pleader submitted no person can claim any relaxation in the matter of qualifying marks in TET.

The judge said he was in full agreement with the Government Pleader. “Reservation provided for physically challenged persons is not taken away by prescribing the minimum qualifying marks,” the judge said and dismissed the plea.
