High Court quashes Rajasthan University elections

Jaipur: A single judge bench of Rajasthan High Court yesterday quashed the election of Rajasthan University held in August this year holding that the moral code of conduct was flouted.

Justice M N Bhandari said that the code of conduct fixed by the Lyngdoh committee has not been followed in the elections.

The code of conduct strictly states that no candidate shall use any poster, banner or any printed material for campaigning but contrary to this, every candidate has defied the rule, the judge said.

Besides, the rule says that the campaign should be confined to the university premises and the election expenditure should not be more than Rs 5000.

But the flurry of activities, the fleet of vehicles and the luncheon parties could not have been possible within the stipulated amount, the bench said.  

The order was passed on a writ petition filed by one Saransh Ghiya.

In the order running in more than 50 pages the judge directed that the Rajasthan University is free to hold fresh elections provided an undertaking in form of an affidavit is submitted in the court that the election will be held according to the moral code of conduct set by Lyngdoh Committee.

The bench also held that the state government may frame a policy in accordance with which the election to various student unions may be held.
