Court rejects plea for FIR on Shinde's Hindu terror remark

New Delhi, Apr 6: A Delhi court Friday refused to give a direction to police to register an FIR against Union Home Minister Sushilkumar Shinde for his "Hindu terror" remarks.




Metropolitan Magistrate Harun Pratap rejected RTI activist Vivek Garg's plea for a direction to the police to register FIR on the comments made by the minister during the AICC meet in Jaipur in January.

However, the court allowed Garg to lead his evidence in support of his allegations under section 200 CrPC (examination of complainant).

If the complainant chooses to lead evidence and the court is convinced, it can summon an accused.

The complainant had sought registration of FIR against Shinde alleging that he made "imputations prejudicial to national integration, uttering words with deliberate intent to wound religious feelings of Hindus, defaming them, and insulting their religion and beliefs".

He had also accused Shinde of "promoting enmity between different groups on grounds of religion and wantonly giving provocation with intent to cause religious riots."

Addressing the AICC meeting at Jaipur, Shinde had said, "...We have got an investigation report that be it RSS or BJP, their training camps are promoting Hindu terrorism. We are keeping a strict vigil on all this".

Replying to the complaint, Delhi Police had told the court that Shinde did not make the remarks with any malicious intention and has already expressed regret for it.
