Ahmedabad: Challenging the order of the sessions court, a local worker of Aam Aadmi Party today approached the Gujarat High Court seeking issuance of a notice to Prime Minister Narendra Modi in connection with his election affidavit in 2012.

Nishant Verma has also demanded notice to the then Returning Officer P K Jadeja of Maninagar assembly constituency here.

Verma alleges Modi did not reveal his marital status in his affidavits accompanying the nomination when he had contested the assembly elections between 2002 and 2012.

"If the notice is not issued...Then the revision application filed before the sessions court will become ineffective," Verma's petition in the HC says.

The sessions court, under the Criminal Procedure Code, must issue the notice so as to give Modi and Jadeja an opportunity to be heard, it says.

Additional Sessions judge G N Rana had, on October 10, rejected Verma's plea seeking notices to Modi and Jadeja.

Verma has moved the sessions court after the magistrate's court dismissed his plea for action against Modi over his allegedly defective affidavit in 2012 on the ground of delay of one year.

Modi had left the column of information about spouse in his election affidavit blank in 2012. He disclosed his marital status and the name of his wife only during this year's Lok Sabha elections.
