The juvenile convict who spent nearly three years at a rehabilitation centre,  has already been moved out of Delhi. He is set to be released on Sunday.

"Crime has won and we have lost (Jurm jeet gaya, hum haar gaye)" was the immediate reaction of the family of the December 16 gangrape victim, after the Delhi High Court refused to stay the release of the juvenile convict.

"Despite all our efforts for three years, our government and our courts have released a criminal. The assurance we were given that we would get justice, that has not been delivered. We are very disappointed. We haven't seen him, not met him, but despite all our efforts, the criminal will walk free," Asha Devi, mother of the victim, said, adding their three-year-old battle for justice has gone in vain.

The convict, who is now 20 years old and was known to be the most brutal of the attackers, has been taken to an undisclosed location from a correction home in North Delhi amid concerns that there was threat to his life.

Meanwhile National Commission of Women in its last ditch attempt to hold the release of the convict has filed a plea in the Supreme Court. In its plea the woman panel has  cited an IB report which points to the convict being "completely unremorseful and has been further radicalised by association with other juvenile convict in Special Home".

The Supreme Court today refused a midnight hearing on a petition filed by the Chairperson of the Delhi Commission for Women (DCW) Swati Maliwal against the scheduled release of the Nirbhaya gang-rape juvenile convict on Sunday. However, the case will be taken up for hearing by the apex court on Monday.

Last week, the Delhi high court refused to stay the release of the juvenile, allegedly the “cruellest” among those who raped and killed the 23-year old paramedic in December 2012.

Sources said the juvenile has been kept under observation of an NGO under protection of Delhi Police.
