Madras HC dismisses plea by hotel firm for higher FSI

Chennai: Madras High Court yesterday dismissed a plea by a firm seeking a direction to the Defence Ministry to allow an higher floor space index for a proposed hotel in a cantonment area here and




After a direction from the court in 2003 to consider the request, the Defence Ministry rejected it on January 19, 2004.

From that date on, the petitioner was continuously filing petition after petition. He had made the latest representation to the Ministry on September 5, 2012.

The Judge said in view of rejection of earlier representations on merits and taking into account the Building Laws and absence of revision or amendment to such laws, fresh representation for the very same relief was not maintainable and dismissed the petition.
