Madras HC sets aside 2 different Government Orders

Chennai: Madras High Court yesterday set aside two different Government Orders issued in 2012 and 2014, prescribed for awarding weightage marks to candidates who appeared in the teachers eligibility test.The orders were of October 5,

The Judge noted that experts in statistics were not included in the committee nor was opinion obtained from them and said the committee constituted to evolve the methodology to select candidates cannot be stated to be an expert body.

He also said no scientific study was conducted by any expert body before introducing the system and it has to be necessarily held that the methodology stipulated in the GOs suffers from arbitrary exercise of power of the government.

The judge flayed the grading method prescribed and also the government for not examining if the method was reasonable and would achieve the object, if any.

The Judge said it is the court's constitutional obligation to set aside the same instead of leaving it to perpetuate.

He dismissed petitions seeking relief to award weightage marks as per the GO and suggested the government prescribe any other scientific method to award weightage marks.
