Uttarakhand crisis: Nainital HC allows Speaker’s counsel to argue today in disqualification case

The Nainital High Court will today hear petitions of 9 dissident Congress MLAs, who are at the centre of the ongoing political crisis in Uttarakhand, challenging their disqualification from the state assembly.

New Delhi: The Nainital High Court today allowed the counsel of Uttarakhand Speaker Govind Singh Kunjwal to argue today over the disqualification of 9 rebel Congress MLAs from the Assembly. The court, on the other hand, also agreed to listen the argument of all disqualified MLAs, who are at the centre of the ongoing political crisis in Uttarakhand, on April 25.

The disqualified MLAs have challenged the notice issued by Speaker Govind Singh Kunjwal on March 19 and his decision to disqualify them on March 27. They have also sought directions of court to allow them to participate in House proceedings.

The MLAs had moved the High Court on two grounds that they were not given enough time by the Speaker to respond to the charges, and that they were not provided ‘proof’ of their alleged anti-party activity.

All the 9 MLAs were disqualified from the assembly under the anti-defection law but eight of them have challenged the Speaker’s decision in the court.

Also the disqualified MLAs had yesterday filed a petition in the Supreme Court questioning the constitutional validity of their disqualification.

If the rebels are disqualified, the House strength comes down to 61. The Congress, with 27 legislators, may then win the trust vote if the six MLAs from smaller parties and independents back it. The BJP has 28 MLAs.

Yesterday, the Supreme Court stayed the HC’s order quashing imposition of President's Rule in the hilly state till April 27.
